Terms of Use

Last updated: 6 November 2026

These Terms of Use (the “Terms”) govern access to and use of Airbot, including the airbot.app website, the dashboard, the assistant (widget) installed on websites and the related services (together, the “Service”). Airbot is a product of ARQEMUS LIMITED, a company incorporated in Hong Kong whose correspondence address is Unit 2904-05, 29/F, Universal Trade Centre, 3 Arbuthnot Road, Central, Hong Kong (“ARQEMUS”, “we”, “us”) — https://arqemus.com/.

By creating an account, starting a trial, subscribing or using the Service, you accept these Terms on behalf of yourself and of the company you represent (the “Customer”, “you”). If you do not accept them, do not use the Service. Our Privacy Policy forms part of these Terms.

1. The Service

Airbot is an AI assistant that a Customer installs on its own website by adding a line of code. It reads the content of the Customer’s website, answers its visitors (“Visitors”) and can perform actions at their request on that website: searching, opening a page or product, choosing options, adding to the cart, filling in a form or pre-filling a checkout. It never completes a payment: the Visitor always confirms and makes the payment on the Customer’s website.

The Service is intended exclusively for professionals acting for the purposes of their trade, business or profession. You confirm that you have the authority to bind the Customer.

We continuously improve the Service and may add, modify or remove features. If a change materially reduces a paid feature you rely on, we will inform you in advance. Features presented as “beta”, “preview” or free are provided as they are, may change or be withdrawn at any time and are excluded from any commitment of availability.

2. Account

You must be of legal age, provide accurate information and keep it up to date. You are responsible for the confidentiality of your credentials and for all activity under your account, including that of the users you invite. Notify us immediately at support@airbot.app of any unauthorised use.

You may only connect websites that you own or that you are authorised to operate. For security reasons, the assistant only works on the domains registered for your site.

3. Plans, trial and payment

The plans, their prices, their included quotas (for example the number of AI conversations or live voice sessions per month) and their options are described on our pricing page at the time of subscription. Prices are in US dollars and exclude taxes, which are added where applicable.

Free trial: new Customers may benefit from one free trial of 14 days per company. A valid payment method is requested when the trial starts. Unless you cancel before the end of the trial, the subscription starts automatically and the first period is charged to that payment method.

Subscriptions are billed in advance for each period (monthly unless otherwise agreed) and renew automatically for successive periods of the same length until cancelled. Payments are processed by our payment provider Stripe. One-time options (for example removal of the Airbot mention in the widget) are billed when ordered.

Quotas: when a quota is reached, we may limit the Service until the next period or invite you to move to a higher plan. On plans that provide for it, usage beyond the quota is billed at the rate shown on the pricing page or in your agreement.

Price changes: we may change our prices for future periods by giving you at least 30 days’ notice. If you do not accept the change, you may cancel before it takes effect.

Late or failed payment: if a payment fails, we may suspend the Service after notifying you, until the situation is regularised.

Except where the law provides otherwise or we expressly agree, sums paid are not refundable, including for a period that has started.

4. Cancellation

You can cancel your subscription at any time from the dashboard or by writing to support@airbot.app. The cancellation takes effect at the end of the current period: the Service remains available until then, then the assistant is deactivated on your website. No refund is due for the period already started.

5. Your obligations

As the operator of the website on which the assistant is installed, you remain responsible towards your Visitors. In particular, you undertake to:

  • keep the information on your website (products, prices, stock, delivery, conditions of sale) accurate and up to date, since the assistant relies on it;
  • remain solely responsible for your offers, your sales, their performance and your compliance with consumer law, including pre-contractual information and the right of withdrawal;
  • inform your Visitors, in your own privacy policy, of the use of an AI assistant provided by ARQEMUS and of the processing it involves, and collect their consent where the law requires it (in particular for the use of browser storage);
  • configure the assistant with lawful, fair and accurate instructions, and not ask it to mislead, pressure or discriminate against Visitors;
  • not deploy the assistant on websites directed primarily at children, or for regulated advice (medical, legal, financial) without appropriate human supervision;
  • regularly review the conversations and contact requests received in your dashboard.

6. Acceptable use

You must not, and must not allow anyone to:

  • use the Service in breach of the law or the rights of others, or to distribute illegal, misleading, defamatory, hateful or infringing content;
  • copy, decompile, reverse-engineer or attempt to extract the source code, models, prompts or engines of the Service, except where the law expressly allows it;
  • circumvent the security measures, the restriction to authorised domains, the quotas or the billing of the Service;
  • install the assistant on a website you do not control, or use it to collect data from third-party websites;
  • send automated requests in volumes that harm the Service, test its vulnerabilities without our written consent, or introduce malicious code;
  • resell, sublicense or provide the Service to third parties without our written agreement;
  • use the Service to develop a competing product.

7. Artificial intelligence

The assistant generates answers automatically using AI models. Despite the care taken, these answers may be incomplete, inaccurate or unsuited to a particular situation. They do not constitute professional advice and do not engage the Customer’s commitments beyond what its website states.

The actions the assistant performs on the website are carried out at the request of the Visitor and on the basis of the information displayed by that website. On checkout pages, the assistant asks for explicit confirmation and never completes the payment.

We do not guarantee any particular commercial result (conversion rate, revenue, number of contacts).

8. Information for Visitors

If you use the assistant on a merchant’s website, it is provided to you by that merchant, which remains your only contracting party for any purchase, quote, booking or service. Check the price, availability and characteristics displayed before ordering; any order and payment are made by you on the merchant’s website, under its own conditions of sale. Do not share sensitive information with the assistant. Your data is processed as described in the merchant’s privacy policy and in our Privacy Policy.

9. Intellectual property

The Service, including its software, widget, engines, interfaces, designs, documentation, trademarks and logos, as well as their improvements, are and remain the exclusive property of ARQEMUS or its licensors. Certain technologies of the Service are the subject of patent applications. During your subscription, we grant you a non-exclusive, non-transferable right to use the Service for your own business, in accordance with these Terms.

You keep all rights to your content and data (texts, catalogues, images, brands, conversations with your Visitors). You grant us a non-exclusive, worldwide licence to host, copy, analyse and process them solely to provide, secure and improve the Service during the subscription and for the period strictly necessary afterwards.

We may use technical information about the structure of websites (for example the layout of pages and interface elements) and aggregated statistics that identify neither you nor any person, in order to improve the reliability of the Service.

Unless you have subscribed to the corresponding option, the widget displays a discreet Airbot mention. Unless you object by writing to us, we may cite your company name and logo as a reference.

If you send us suggestions or feedback, we may use them freely without obligation to you.

10. Data protection and processing on your behalf

For personal data about Visitors, you are the controller and ARQEMUS is your processor. By accepting these Terms, you instruct us to process this data to provide the Service, as described in the Privacy Policy. In this capacity, ARQEMUS undertakes to:

  • process the data only on your documented instructions, which consist of these Terms and your settings in the dashboard, unless required to do otherwise by law;
  • ensure that the persons authorised to process the data are bound by confidentiality;
  • implement appropriate technical and organisational security measures;
  • use only sub-processors bound by equivalent obligations, listed in the Privacy Policy, and inform you in advance of any change, giving you the opportunity to object;
  • assist you, as far as possible, in responding to requests from data subjects and in meeting your obligations regarding security, impact assessments and breach notification;
  • notify you without undue delay after becoming aware of a personal data breach affecting your data;
  • delete the data at the end of the subscription, within the time limits indicated in the Privacy Policy, unless retention is required by law;
  • make available the information necessary to demonstrate compliance with these obligations and allow audits under reasonable conditions (prior notice, confidentiality, at your expense).

For transfers outside the European Economic Area or the United Kingdom, the safeguards described in the Privacy Policy apply. A separate data processing agreement can be signed on request.

11. Confidentiality

Each party undertakes to keep confidential the non-public information received from the other in connection with the Service, to use it only for the purposes of these Terms and to protect it with reasonable care. This obligation does not apply to information that is public, already known, independently developed or that must be disclosed by law.

12. Availability and support

We use commercially reasonable efforts to keep the Service available and to correct anomalies, but we do not guarantee uninterrupted or error-free operation. The Service may be interrupted for maintenance, updates, security reasons or events beyond our control. Unless a specific agreement provides for a service level, no compensation is due for unavailability.

Support is available by email at support@airbot.app.

13. Suspension and termination

We may suspend or terminate access to the Service, after notice where possible and immediately in urgent cases, if you breach these Terms, fail to pay, use the Service in a way that endangers its security or third parties, or if the law requires us to do so.

You may close your account at any time. Before closing, you can export your contacts and statistics from the dashboard. After the end of the subscription, your data is deleted within the time limits set out in the Privacy Policy.

Provisions which by their nature should survive termination (in particular payment, intellectual property, confidentiality, liability and governing law) remain in force.

14. Disclaimer of warranties

To the extent permitted by law, the Service is provided “as is” and “as available”. ARQEMUS excludes all express or implied warranties, in particular of merchantability, fitness for a particular purpose, accuracy of AI answers and non-infringement, other than those expressly set out in these Terms.

15. Limitation of liability

To the extent permitted by law, ARQEMUS is not liable for indirect or consequential damages, loss of profit, revenue, business, opportunity, data or reputation, or for damages resulting from the content of your website, from your offers and sales, or from decisions taken on the basis of AI answers.

ARQEMUS’s total liability, all causes combined, is limited to the amounts actually paid by the Customer for the Service during the twelve (12) months preceding the event giving rise to the claim.

These limitations do not apply in the event of fraud, gross negligence or wilful misconduct, death or personal injury, or in any other case where the law prohibits limiting liability.

16. Indemnity

You will defend and indemnify ARQEMUS against any claim by a third party, including a Visitor or an authority, resulting from the content of your website, your offers and sales, the instructions you give to the assistant, or your breach of these Terms or of applicable law, in particular consumer and data protection law.

17. Changes to these Terms

We may amend these Terms. Material changes are notified to you by email or in the dashboard at least 30 days before they take effect, unless they are required sooner by law or for security reasons. If you do not accept them, you may cancel your subscription before they take effect; continuing to use the Service afterwards constitutes acceptance.

18. Governing law and disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The parties will first seek an amicable solution by writing to each other. Failing agreement within 30 days, any dispute will be submitted to the exclusive jurisdiction of the courts of Hong Kong, without prejudice to the mandatory rules that may apply to you.

19. General provisions

These Terms, the Privacy Policy and, where applicable, an order form or specific agreement constitute the entire agreement between the parties regarding the Service; in the event of conflict, the specific agreement prevails. If a provision is held invalid, the others remain in force. A party’s failure to enforce a right does not constitute a waiver. Neither party is liable for a failure caused by force majeure. You may not assign the contract without our consent; we may assign it to an affiliate or a successor. These Terms are available in English and French; in the event of discrepancy, the English version prevails.
